But all of this is "free" money: personal health law suits; hundreds of thousands of dollars in income for consultants driving around in air conditioned SUVs and typing reports in air conditioned offices; exorbitant rent income for political supporters; money for constructing new capital projects over budget - and on and on. When will V.I. senators stop worrying about who will or will not be happy with their decisions and do what is best for the Virgin Islands' community? Like marriages, communities are rarely 100 percent in agreement, but as concerned citizens we must insist that our senators be committed to community enhancement and growth. We must keep printing and voicing our solutions until they are achieved. Those who don't like the majority decisions will leave. When high-level administrators and senators bring their salaries in line with what tax revenues can bear, I will know they care. THOMAS -- Lawyers who have fought to keep three youths from facing prosecution as adults on murder charges related to the brutal beating of 65-year-old William Hyde last November have failed, clearing the way for two final youths to be bound over as adults in Superior Court. Family Court Judge Debra Smith-Watlington ordered the five teenagers be transferred to the jurisdiction of the Superior Court in March. The youths' filed appeals claiming the order was unconstitutional. Among the arguments in their appeals were that law enforcement had insufficient knowledge of their ages,Orlando Magic Youth Custom blue Jersey, that trying them as adults would violate the eighth amendment - which prohibits cruel and unusual punishment - and that the Virgin Islands was an improper venue for the trial because Hyde actually died in Florida. The Supreme Court upheld transfer orders for Jelani Gumbs and two other youths, who have not been named as yet in Superior Court documents, Friday. The two unnamed youths also filed motions to stay the case until the Supreme Court returned a decision on their appeals. Gumbs, therefore, was arraigned with N'Kai Colon and Dionno Brooks, while the other defendants remained in the custody of the Department of Human Services at the St. Croix Youth Rehabilitation Center. After Hyde was found lying unconscious in a pool of his own blood in the early morning hours of Nov. 24, he was rushed to Schneider Hospital and was later flown to a Florida hospital because his injuries were so severe. He died Dec. 17 at Jackson Memorial Hospital in Miami. Police arrested and charged the suspects in the case with assault between Dec. 10 and Dec. 12. Prosecutors upgraded the charges against all defendants to murder Jan. 18. The upgraded charges allow the youth to be tried in Superior Court and removes any obligation to shield their identities from the public. Gumbs, Colon and Brooks - all Ivanna Eduora Kean High School students - face first-degree and second-degree murder charges as well as assault and weapons charges related to the slaying of Hyde. They also are charged with kidnapping, possession of stolen property and aiding and abetting. All three defendants pleaded not guilty at a June 13 arraignment. Attorneys representing Gumbs and Brooks entered objections to the first-degree murder charges on the basis that they violate a U.S. Supreme Court decision Miller v. Alabama. That decision establishes that youths convicted of homicide cannot be sentenced to life without parole. With respect to youths, Miller states that life without parole would constitute "cruel and unusual punishment" and defy their eighth amendment rights.
